1. DMCA Compliance Statement

PNGPack.com respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we have implemented procedures for receiving written notification of claimed copyright infringement and for processing such claims in accordance with the law.

As a platform that creates and distributes original content, we take copyright protection seriously and maintain a strict policy regarding copyright infringement. All content on PNGPack.com is created by our in-house design team, and we do not knowingly host or distribute infringing material.

3. Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on PNGPack.com, you may notify our designated DMCA agent by providing the following information in writing:

Required Information:

1. Identification of the copyrighted work: A detailed description of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notification, you may provide a representative list of such works.

2. Identification of the infringing material: Provide the exact URL(s) or specific location(s) on PNGPack.com where the allegedly infringing material is located. Please be as specific as possible to help us locate the content quickly.

3. Your contact information: Include your full legal name, mailing address, telephone number, and email address.

4. Good faith statement: Include the following statement: "I have a good faith belief that use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law."

5. Accuracy statement: Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

6. Physical or electronic signature: Provide a physical signature or electronic signature (typed full legal name) of the copyright owner or person authorized to act on their behalf.

4. Our Response Process

Upon receipt of a valid DMCA takedown notice that complies with the requirements above, PNGPack will:

Step 1 - Acknowledgment: Send an acknowledgment of receipt within 24-48 hours.

Step 2 - Investigation: Promptly investigate the claim by reviewing our internal creation records, design files, and documentation to verify ownership.

Step 3 - Temporary Action: If the claim appears legitimate and there is uncertainty about ownership, we may temporarily disable access to the disputed content pending resolution.

Step 4 - Review and Response: Complete our investigation within 5-7 business days and provide a written response explaining our findings and actions taken.

Step 5 - Final Action: Either restore the content with proof of original creation, or permanently remove it if infringement is confirmed.

5. Counter-Notification Process

If content has been removed or disabled as a result of a DMCA notice and you believe the removal was made in error or misidentification, you may file a counter-notification with our designated DMCA agent. As the content creator and copyright owner of all materials on PNGPack, we reserve the right to file counter-notifications for our own content if we determine a DMCA claim was made in error.

Counter-Notification Requirements:

A valid counter-notification must include:

1. Your physical or electronic signature

2. Identification of the material that was removed and its location before removal

3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification

4. Your name, address, telephone number, and email address

5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, for any judicial district in which PNGPack may be found, and that you will accept service of process from the person who provided the original DMCA notice

6. Important Legal Notices

Penalties for False Claims:

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. This means you could be held liable for damages, including costs and attorneys' fees, if you make a false DMCA claim.

7. Repeat Infringer Policy

While PNGPack creates all content in-house and does not accept user uploads, we maintain a policy of terminating relationships with parties who are determined to be repeat copyright infringers in appropriate circumstances. This includes third-party partnerships, affiliates, or any external contributors should our business model expand in the future.

8. Original Content Creation

It is important to note that PNGPack operates differently from user-generated content platforms. We do not accept, host, or distribute user-uploaded content. All images and graphics available on PNGPack.com are:

• Created entirely by our professional in-house design team
• Original works with full documentation of the creation process
• Owned exclusively by PNGPack with all associated intellectual property rights
• Subject to our internal quality control and copyright verification procedures

This means that valid DMCA claims against PNGPack content would be extremely rare, as we maintain complete creative control and ownership. However, we provide this DMCA policy to comply with legal requirements and to address any legitimate concerns from copyright holders.

9. Trademark and Fair Use

Please note that this DMCA policy addresses copyright infringement claims. Many of our PNG images depict social media icons and brand symbols (such as WhatsApp, Facebook, Instagram logos) which are protected trademarks of their respective owners. Our use of these symbols in creating icon graphics falls under nominative fair use and serves the functional purpose of allowing users to link to and reference these platforms. Trademark concerns should be addressed separately from copyright claims and sent to our legal contact.

10. Modifications to This Policy

PNGPack reserves the right to modify this DMCA policy at any time. Changes will be posted on this page with an updated revision date. Continued use of PNGPack.com following any changes constitutes acceptance of those changes.
